Business groups push for the creation of an Administrative Court

28 business associations are lobbying for the creation of an Administrative Court and for putting the law concerning the creation of the institution on the immediate agenda of the new government, reports the local press (Agon, 4.09.2009). Business associations are preparing to inaugurate an intensive campaign to mobilize enterprises and citizens in favor of a rapid decision on the creation if the Administrative Court. This would help resolve conflicts between administrative bodies and conflicts between citizens (physical persons) and judicial persons and the country’s administration. The business associations expect and are lobbying with the claim that the issue be passed off in the new parliament by this autumn.

The efforts of this business coalition for the creation of the Administrative Court have been on-going. Since spring 2009 a number of business associations joined forces and asked the former parliament to deal with the issue before the June 28th elections. On the 17th of May 2009, Agon discussed the issue in an article titled, “Business makes last call for Administrative Courts.” Since then the group of business associations has been enlarged. The approval of the law on the creation of the Administrative Court requires 84 votes, informs Agon, emphasizing that its approval would require support by the opposition as well as from the ruling parties. But so far the Socialist Party, the main opposition party, has threatened a possible boycott of the parliament, suggested conditional participation or even suggested full participation and has been frequently changing promises resulting in unstable expectations for the immediate future. “We should first coordinate in order to include the draft project for the creation of the Administrative Court on the agenda of the new parliament, and then make sure of the oppositions participation at the time of the examination and vote of the draft, ” declared Filloreta Luli-Faber, director of the American Chamber of Commerce.

Earlier Konfindustria, an association of the confectionary producers and servicers, had qualified the Administrative Court as a, “missing and necessary part of the judiciary system in Albania,” (Agon, 17.05.2009).

The creation of the Administrative Court, which would resolve in an independent manner conflicts between business and government, is expected to improve the business climate.
